WIN A CINEMATIC TRIP TO HAWAII COMPETITION

Official Rules

1. Sydney Film Festival. ABN: 84000233741 of Level 2, 10 Hickson Road, The Rocks, Australia 2000 (“Promoter“) is conducting a competition offering participants the chance to win a trip to Hawaii (“Competition“).

2. By entering and/or participating in the competition, you agree to the following terms and conditions.

3. Instructions, prizes and information on how to enter form part of these Terms and Conditions.

4. All entries must comply with these Terms and Conditions to be valid.

Competition Timing

5. The ‘WIN A CINEMATIC TRIP TO HAWAII’ competition begins at 12.01am AEDT on 14 February 2024 and ends at 11.59pm AEDT on 19 May 2024 (“Competition Period“). Time will be determined according Promoter’s timekeeping systems. The timeliness of any action or inaction relating to the Competition will be determined in the Promoter’s sole discretion.

Eligibility

6. Entry is open to residents of Australia or New Zealand who are over the age of eighteen (18) years old. Entrants are required to provide personally identifiable information to Promoter.

7. Employees of the Promoter and their respective subsidiaries, affiliates, officers, agents and the immediate family members of each are not eligible to participate in the competition. Proof of identity must be furnished upon request.

Entry

8. To enter the Competition, entrants must purchase a Flexipass or Subscription to the 71st Sydney Film Festival via the sff.org.au website, box office, or mail form (“Entry“).

9. Entrants must also consent to joining the marketing mailing list of Sydney Film Festival, Hawaiian Airlines and Hawaii Tourism via an opt-in checkbox when booking or by informing the SFF staff of their opt-in to materials.

10. Each Flexipass or Subscription purchased will be considered one entry.

11. Entries made via purchases prior to 11.59pm on May 7 will have their entry doubled (two entries per purchased Flexipass or Subscription). Purchases made prior to the announcement of the competition will also still be eligible.

Prize Draw

12. One (1) potential winner will be drawn via a random electronic draw at of Level 2, 10 Hickson Road, The Rocks, Australia 2000 on 23 May 2024 (“Prize Draw Date“) and the Prize will be awarded to the first person drawn following winner validation and verification (“Winner“).

13. Winner will win the following prize up to the approximate value of AUD$7,400 (“Prize“):

  • One (1) trip to Hawaii, USA for two (2) people including:
    • Five (5) nights accommodation in Outrigger Reef Waikīkī Beach Resort, up to 2 people in the room.
      • Block out dates apply.
  • Up to four (4) people on a Hollywood Movie Site tour of Oahu Movies Locations on Kualoa Ranch
    • Block out dates apply.
  • Up to four (4) people on an electric assist Mountain Bike tour of Kualoa Ranch
    • Block out dates apply.
  • 180,000 HawaiianMiles to redeem for travel on Hawaiian Airlines, equivalent to two return economy tickets to Honolulu ex Sydney.
    • Prize must be claimed by 31 July 2024 with the use or creation of a HawaiianMiles account which is free to join.
    • Miles do not currently have an expiry date but conditions are subject to change. Miles may take up to 30 business days to be credited.
    • Travel must be booked on Hawaiian Airlines operated flights only.
    • Winners will be responsible for their own Visa waiver to enter the USA.

14. Winner will be notified via phone, or email, by 30 May 2024. The name of the Winner will also be published on www.sff.org.au from 30 May 2024 for a period of thirty (30) days. All reasonable efforts will be taken to contact the Winner. The Promoter takes no responsibility for unread, undelivered or incorrectly provided contact information.

15. Once the Winner has been verified, the Winner must provide a valid telephone number and mailing address in order to arrange for delivery of the Prize. Entrants agree to comply with the Promoter’s reasonable instruction/direction to claim the Prize.

Unclaimed prizes

16. If the Winner cannot be contacted and the Prize remains unclaimed at 5.00pm (AEDT) on 1 June 2024, a second potential winner will be drawn on 2 June 2024 (“Winner 2“) and will be deemed the Winner. Winner will be deemed to have forfeited the Prize and hence, will have no claim to the Prize.

17. Winner 2 will be notified by email and telephone within one (1) business day of 2 June 2024. The name of the Winner will also be published on www.sff.org.au from 2 June 2024 for a period of thirty (30) days. All reasonable efforts will be taken to contact the Winner.

18. The process outlined in clauses 14 and 15 will be repeated until a Winner is contacted and accepts the Prize (allowing for the day time frames to be adjusted).

Conditions

19. Entrants and participants in the Competition are responsible for ensuring their familiarity with the Terms and Conditions at the time of participation. The Promoter’s decision not to enforce its rights or any specific restriction (whether communicated to an entrant or not) does not constitute a waiver of those rights, restrictions or of the Terms and Conditions generally.

20. The Prize and all elements of the Prize must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable. The Prize is subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including, as relevant:

  1. booking and availability
  2. entry into any event venues (including behaviour requirements, COVID safety requirements and applicable dress codes); and
  3. any additional fees (payable by the Winner) relating to changes made by the Winner to the Prize after it has been booked.

21. The Winner/s are responsible for all other unspecified costs related to the Prize, including meals and drink (outside of the Prize), travel insurance, passport, Visas, transport, costs associated with ongoing use of any parts of the Prize, etc.  The Promoter does not control entry to the relevant event location.

22. The winner (and their travel companion/s) must satisfy the Promoter as to their health and fitness for travel.

23. As a condition of accepting the Prize, winner (and their travel companion) may be required to sign a legal document as and in the form required by the Promoter in their absolute discretion, including but not limited to a legal release and indemnity. Promoter shall have no liability for Winner’s inability to travel due to failure to comply with any government regulations relating to travel (i.e. Covid-19 requirements).  If the Winner does not sign any such document, their entry will be deemed invalid and they will lose any entitlement to the Prize.

24. The Promoter is not responsible for any dispute between the Winner and any person with whom they choose to, or choose not to, share the Prize.

25. Participants acknowledge that the Promoter can rely on these Terms and Conditions even if the Promoter only learns of a Participants ineligibility after the Promoter has awarded a prize to the ineligible entrant.

26. Entries not complying with these Terms and Conditions are ineligible and the Promoter reserves its absolute right to disqualify any entrant from the Competition if any entries do not comply with these Terms and Conditions.

27. The Promoter’s (or an associate of the Promoter) decision in relation to any aspect of these Terms and Conditions is final and binding on every person who enters. No correspondence will be entered into.

28. The Promoter is not liable for Entries, Prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.

29. A request by an entrant to modify any information provided should be directed to the Promoter.

30. The Prize is not transferable or exchangeable nor can it be redeemed for cash. Without limiting any other term of these Terms and Conditions, the Prize (and elements of the Prize) must be taken as and when specified, or will be forfeited with no replacement.  The Prize value is correct as at the date of preparing these Terms and Conditions and include any applicable GST.  The Promoter is not responsible for any change in the Prize value.

31. If the Prize or any element of the Prize becomes unavailable for any reason beyond the Promoter’s control, such as force majeure event, or major disruption with one of businesses offering prize elements, then the Promoter will not be responsible in providing a substitution of the prize, and the Prize and any element of the Prize will be forfeited without any compensation to the winner. No cash will be provided to the winner under any circumstances for any element unable to be delivered to the winner beyond the Promoter’s control.

32. The Winner will provided all information and contact details required to redeem the Prize. The Promoter does not take any responsibility for the booking, administration or organisation of the prize redemption once information has been provided.

33. Any tax liability arising because of accepting the prize is the winner(s) responsibility.

34. All prize advertisements depicting or describing the prizes and trade mark references are illustrative rather than depictive and do not imply an associated with the Promoter.

35. If for any reason any aspect of this competition is not capable of running as planned, including by reason of war, terrorism, state of emergency, disaster, infection by computer virus, telephone network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant authorities, if required.

36. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations.

37. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

38. The Promoter reserves the right to cancel or amend the Competition and these terms and conditions.

39. Any incorrect or incomplete entries which make the winner unable to be easily contacted (all of which will be at the absolute discretion of the Promoter), will be invalid and may be removed by the Promoter.

40. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents), excludes all liability (including negligence), for any personal injury or any loss or damage (including, without limitation, indirect, special or consequential loss or loss of profits), which is suffered or sustained in connection with this competition or accepting or using the Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law.

41. Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this Competition are not liable for any loss of, damage to or delay in delivery of the Prize.

42. By entering this competition, entrants consent to the storage of their personal information on the databases of the Promoter, Hawaii Airlines, Hawai‘i Tourism Oceania, and their related bodies corporate and the Promoter and its related bodies corporate may use this information for future promotional and marketing purposes including contacting entrants via the contact details provided by the entrant. Without limiting the foregoing, Entrants’ personal information provided in connection with this competition will be handled in accordance with the Promoter’s Privacy Statement, and the privacy policies of Hawaii Airlines and, Hawai‘i Tourism Oceania. At an entrant’s request, all information provided to the Promoter will be removed from our databases. The entrant will be required to make separate requests to Hawaii Airlines and Hawaiian Tourism, and the Promoter takes no responsibility for privacy requests made with Prize element suppliers.

43. The laws of NSW, Australia apply to these Terms and Conditions and Participants submit to the exclusive jurisdiction of the courts of NSW, Australia.
